Operating Process and Rules
The below listed rules are effective July, 2006 This issue of the Rules and Regulations for the residents of the Cherokee Village Townhouse Association [CVTA] supersedes all previous issues. These rules were issued July, 2006.
The Board of Directors retains the right to review and modify the Rules and Regulations as conditions may dictate or with the approval of the majority of the membership.
The CVTA was established in 1971 and operates under its Articles of Incorporation, By-Laws, Bill of Assurance, Protective Covenants, and the City of Cherokee Village Codes for the maintenance and preservation of the residence lots, common properties and facilities of the Association and for the promotion of the health safety, and welfare of the Townhouse residents.
The CVTA is managed by a Board of Directors composed of five (5) members, each of whom is elected by the Townhouse owners. These terms are staggered so that only one director is elected in a given year. The Directors elect their own officers to execute the business of the Association.
In managing its responsibilities for the use and maintenance of common properties and facilities of the CVTA, the Board performs, but is not limited to the following operations: C Financial planning and execution of fiscal policy C Arrangements for a property insurance program to cover casualty and liability responsibilities on common properties and facilities of the association C Contract employment of maintenance personnel and payment there of FEstablishing rules and regulations for the use of common properties and facilities, and the enforcement of them F Operations, supervision maintenance and improvements of the CVTA facilities F Purchase and maintenance of equipment to properly operate the facilities F Upkeep and maintenance of outside lighting F Landscaping and appearance of grounds and townhouses The services provided by the CVTA are governed by the collection of annual membership assessments.
A general meeting of the CVTA is held monthly in the Clubhouse Community Room and is open to all members of the CVTA. The Board of Directors meets at other times, as necessary, throughout the year.

Each owner of a townhouse unit automatically becomes a member of the CVTA B. Each member is required to have on file with the CVTA their current address and phone number to ensure an accurate means of communication. Please include an e-mail address if you have one, also. Send this information to CVTA P.O. Box 475, Cherokee Village, AR 72525 C. Owners that rent their townhouses on their own or through an agency must notify the secretary of the association of the current tenants. D. Each owner of a townhouse unit and their family members dwelling therein shall have the right of enjoyment and the use of all CVTA common properties and facilities such as the Community Room and Pools subject to the Rules and Regulations governing their use. E. The Board of Directors has the authority to charge reasonable user fees for these facilities. F. The Board of Directors has the right to suspend the use of CVTA facilities/property and voting privileges for any period during which assessments are delinquent and remain unpaid and/or because of violations that failed to comply with the Rules and Regulations of the CVTA. G. As a townhouse owner you are entitled to one (1) vote for each townhouse unit you own. Where ownership is held in joint tenancy the townhouse unit is only allowed one (1) vote. H. Annual Townhouse Owner’s Meetings are held at the call of the President with notice being mailed to all members by the CVTA Secretary as designated in the by-laws. Assessments A. Maintenance assessments are prescribed by the Articles of Incorporation, By-Laws and Bill of Assurance covering the CVTA. The purpose of these assessments is to provide services and facilities related to the esthetics, use and enjoyment of the area, and to promote the recreation, safety and welfare of all townhouse residents. B. The Board of Directors has the authority to raise or lower the assessments with a majority vote of the membership at any time. C Assessments are currently five hundred ten dollars ($510.00) for each townhouse unit and will become a lien against the property if not paid within the year for which they are due. Assessments are payable in two ways: 1. In full on or before February 1st of each year or 2. In ten (10) equal payments of fifty-one dollars ($51.00) each month commencing February 1st and continuing, without interruption, through November 1st of each calendar year. D. Should the payment in full not be made on or before February 1st or the ten (10) payment plan is interrupted or defaults, a ten dollar ($10.00) penalty, per month, will be applied each month until the full or total amount is paid and this will also become a part of the lien if necessary. E. Assessments are the responsibility of the Townhouse Owner, not the tenant. However, the tenant will be denied access to CVTA facilities, along with the owner, if the fees are not paid. F. Townhouse Owners are responsible to see that their tenants follow CVTA rules and both may lose CVTA privileges for infractions. G. If, at any time, a townhouse unit is sold, it is necessary that all assessments are current. The owner on the first day of the month, is responsible for that month and the new owner will owe for the first business day of the month after closing.
Protective Covenants A. Protective Covenants govern the general appearance of all property within the CVTA area and include among other items: fences, walls, clothes lines, garbage and trash cans, commercial vehicles, boats and trailer, RV units. The Association is vested with the power to enforce regulations pertaining thereto. This includes the colors chosen when repainting or siding a townhouse unit. Paint or siding color selections must be presented to the CVTA Board for approval. Therefore, an owner desiring to change the color of a unit must obtain written approval from all neighbors in the multi-structure and submit this along with the paint/siding color selection to the CVTA Board at their monthly meeting. Each Board Member has the current color options. B. Any structural construction such as carports, roofing, extended pads, etc., must have prior approval by the CVTA Carports and extended pads or driveways may require a lease and fee from the CVTA Board and a building permit from the Planning and Zoning Department of Cherokee Village. C. Should owners desire to use a roofing material other than asphalt shingles they must have written permission from all adjacent owners and the CVTA Board before proceeding. Pass Cards A. The CVTA Community Room and Pools are secured with electric locks. The locks are controlled by computerized coded pass cards that will not be reissued each year. B. Each Townhouse Owner, whose assessments are current and privileges have not been revoked, are entitled to one (1) pass card per townhouse. C. Replacement pass cards are available through the CVTA Board for fifty dollars ($50.00) in the event of loss. A change in ownership will result in a new card for the new owner.
D. All tenants will be required to secure Board approval to receive a pass card. Approval may be given upon the receipt of: 1 evidence of a one (1) year lease, 2 payment of a seventy-five dollar ($75.00) fee, refundable at the end of the lease, 3 a letter from the owner stating that it is okay to provide the tenant with a card.
If the tenant leaves before the lease is full-filled their deposit will be mailed to them if the pass card is returned to the board. Cards will be given directly to the tenant at a monthly board meeting. Community Room A. Community Room privileges are reserved for persons holding membership in the CVTA and their guests. B. Townhouse Owners must sign up in advance for the use of the room stating the time (beginning and end) of their usage. A calendar is provided in the kitchen of the Community Room for this purpose. C Members using the facilities for any purpose are responsible for leaving the Community Room and kitchen in a clean and orderly condition. Table and chairs used for the function are to be leaned, taken down and returned to their storage area. All rubbish must be removed by the user. D. Members are responsible for seeing that all lights (check the bathrooms, pool and other hallways) are turned off after their use of the building and that all doors are locked when they exit. E. A Townhouse Owner must be present when any persons under the age of twenty-one (21) are using the Community Room. Anyone, other than the Townhouse Owner is considered to be a guest. If anything is damaged, the Townhouse Owner is responsible for any repairs and replacement caused by their guests or themselves. F. The CVTA Community Room may not be used for any commercial activities or endeavors. Indoor and Outdoor Pools A. All swimmers are swimming at their own risk at all times. Lifeguards are not provided at either pool. B. The CVTA is not responsible for injuries or accidents in the pool areas. C. The CVTA is not responsible for items left or lost in the pool areas. D. The use of the pools is limited to Townhouse Owners, their authorized guests, long term Board approved tenants of twelve (12) months or more and other groups specifically approved by the Board of Directors. E. Running, diving, and rough play are prohibited in the pools, pool areas and patios of either pool. Offenders may be asked to leave by townhouse members. F. Proper swimwear is required. Cut-offs or regular clothing are prohibited. Babies must be in swim diapers. G. Pets are not allowed in the pools, pool areas or patio areas of either pool. H. Food and drink are not allowed in either pool areas. Water in plastic cups or plastic bottles may be brought to the pool patio areas. Absolutely NO GLASS ITEMS, for any reason, are allowed in or around the pool and pool patio areas. I. Out of respect for others, rafts or similar floating lounges are not allowed in the pools when others are present. J. A Townhouse Owner or approved long-term tenant must be present when any persons under the age of twenty-one (21) are using the CVTA pools. Anyone, other than the Townhouse Owner is considered to be a guest. K. Pool hours must be adhered to as posted! L. When you leave the indoor pool, please see that the lights in the building are turned off. If you are leaving at the end of the day, please close and lock the pool’s sliding doors. M. Pool parties must obtain permission from the Board of Directors before assuming use of the pool, in order for the party hours to be posted. N. Exercise groups use the indoor pool during a portion of the morning hours and one evening of the week. These groups and times are posted. Plan your personal swimming around these posted times. Mailboxes A. Only townhouse owners may erect a mailbox in front of their townhouse, in the cluster on their stree or attached to their carport (observe the format in your neighborhood) for the delivery of mail. Please inform the Board of your desire to do this as they will need to help determine the location of your mailbox so it complies with the grounds program. B. The, stand alone, mailbox must be a Rubbermaid “Mail Master” model. C. Arrangements for this mail service may be made by contacting the Hardy Post Office. Parking A. Each townhouse unit must use its own designated parking spaces. B. Parking on the grass or lawn area is strictly prohibited in the CVTA area. C. Motorized vehicles, that are recognized by the State of Arkansas as licensable vehicles for general personal transportation are permitted in the CVTA area. Golf carts, all terrain vehicles and the like are not permitted to be parked in the CVTA area. D. RV vehicles of any sort, boats and boat trailers, or trailers of any type, for other than moving day, are prohibited from parking for anything other than loading or unloading. They cannot be parked in carports or guest CVTA parking spaces. E. Only temporary parking on CVTA streets is permitted. NO OVERNIGHT parking is allowed on the CVTA streets. Pets A. Pets are not allowed to run loose in the CVTA area. B. Pets must be kept on a leash and must be accompanied by their owners when they are outside of the townhouse. C. Owners should respect the preferences of others in keeping their pets off those portions of the common property adjacent to townhouse units and must clean up after their pets when they walk them. D. Owners of pets shall take all steps necessary to ensure that their pets shall in no way disturb the peace and quiet of the CVTA neighborhoods. E. Owners of pets shall comply with the Cherokee Village City Codes regarding pets. Safety A. For the safety of all concerned, the CVTA prohibits the use of roller skates, roller blades, skateboard, scooters, coaster wagons and things of a similar nature throughout the entire CVTA area. Laundry A. Hanging such articles as swimming apparel, towels, or general laundry on the decks, carports or railings of townhouse units is not allowed. Signs A. Except for “name” signs of reasonable size and appearance, no signs of any type may be affixed to the outside of any living unit nor placed in or on the common property of the CVTA area. B. No commercial, political or real estate signs may be placed in or on the common property of the CVTA area or on the exterior of the townhouse unit. Noise Restrictions A. All loud activities shall not commence prior to 7:00 AM and must cease at 10:00 PM. This includes, but is not limited to building, remodeling, loud music, parties, vehicles, voices, etc. Resident Sales A. It is prohibited for townhouse occupants – owner or long term tenant – to engage in any activity such as “garage sales”, “carport sales”, “flea markets” or other commercial type sales that cause customer attendance at their residence at any time other than the “Annual (CVTA promoted) Carport Sale” on the Saturday of Memorial Weekend from 7 AM until 2 PM. B. Estate or moving sales must obtain permission from the CVTA Board prior to scheduling the activity. Trash A. A refuse receptacle is to be used in each trash container designated for each townhouse. NO TRASH or refuse is to be visible above the container. B. If the street has group trash containers NO TRASH or refuse is to be visible above the container. C. Trash, rubbish, or things waiting for the trash collectors weekly pick-up may not be placed outside of the townhouse unit before the evening prior to the scheduled pick-up. D. All townhouse units, having street designated areas for trash, must have a receptacle for trash. Bags of trash or rubbish will not be tolerated on the patio area, under decks or stairs or anywhere outside of the townhouse unit. E. Each townhouse resident is to comply with the City of Cherokee Village Refuse regulations. Delegation of Membership A. The Townhouse Owner is responsible for seeing that their tenants comply with the rules and regulations in this booklet and others that they receive notice of. They are also responsible for the recovery of their pass card from the tenant at the end of the tenancy. If the card is found to be used by other parties, the card will become inoperable. (See section C and D under Pass Cards.) B. Tenants receiving recognition as long term residents by their landlords and the CVTA Board, also accept full responsibility for abiding by the rules and regulations set forth by the Board of Directors and acknowledge that their landlords pass card will be rendered inoperable for any violation.
